1. Introduction
1. These Terms and Conditions govern your use of services provided by Mowhay ("we", "us", "our") at Manor Farm, Church Lane, Chilcompton, Somerset BA3 4HP.
2. By booking or using any of our services, you agree to be bound by these Terms and Conditions.
3. We reserve the right to refuse service to anyone at our discretion.
2. Definitions
1. "Client" or "you" means the person booking or receiving treatments.
2. "Services" means all beauty, holistic, and wellness treatments offered by Mowhay.
3. "Appointment" means a scheduled time slot for receiving Services.
4. "Gift Voucher" means a prepaid credit for Services purchased as a gift.
3. Bookings & Appointments
1. Appointments can be made by telephone on 01761 417 149 or 07891 262 929, by email at info@mowhaytreatments.com, or via our online booking system.
2. Our opening hours are Monday to Friday 9am-9pm and Saturday 9am-4pm. We offer flexible hours including evening appointments.
3. When booking online, payment terms will be displayed and may include a deposit requirement depending on the treatment selected.
4. Gift Vouchers can be redeemed directly through our online booking system during the booking process.
5. Your appointment time has been reserved exclusively for you. Please arrive on time to ensure you receive the full duration of your treatment.
6. If you arrive late, your treatment time may be shortened to avoid delaying other clients, and the full treatment price will still apply.
7. We recommend arriving 5-10 minutes early for your first appointment to complete any necessary paperwork.
4. Payment Terms
1. Payment terms for each treatment are specified at the time of booking and will vary depending on the service selected.
2. We accept payment by debit card, credit card in person or through our website.
3. All prices are quoted in pounds sterling (GBP) and include VAT where applicable.
4. We reserve the right to change our prices at any time. Prices quoted at the time of booking will be honoured.
5. Deposits and prepayments are non-refundable but may be transferred to another appointment subject to our cancellation policy.
5. Cancellation & Refund Policy
1. We require at least 48 hours' notice for cancellations or changes to appointments.
2. Cancellations made with 48 hours or more notice will receive a full refund or the option to reschedule without penalty.
3. Cancellations made with less than 48 hours' notice will incur a charge of 50% of the treatment cost.
4. Cancellations made on the day of the appointment or no-shows will incur a charge of 100% of the treatment cost.
5. In exceptional circumstances (such as serious illness or family emergency), we may waive cancellation fees at our discretion. Please contact us as soon as possible to discuss your situation.
6. We reserve the right to cancel or reschedule appointments due to therapist illness, emergency, or unforeseen circumstances. In such cases, we will contact you as soon as possible and offer alternative dates or a full refund.
7. Refunds will be processed within 14 working days to the original payment method.
6. Gift Vouchers
6.1. Validity period
• All Mowhay gift vouchers (printed and e-gift cards) are valid for 6 months from the date of purchase.
• The expiry date is clearly stated on each voucher.
• Vouchers will not be extended beyond the expiry date and cannot be refunded.
• If a voucher expires without being claimed or redeemed, it cannot be extended or refunded.
6.2. Redemption
• Vouchers can be redeemed when booking online or in person at Mowhay.
• A valid voucher code must be provided at the time of booking or payment.
• Vouchers are treated as cash and must be kept safe - lost or deleted voucher codes cannot be replaced.
6.3. Booking & Cancellations
• Appointments made using a voucher are subject to Mowhay’s standard booking and cancellation policy.
• If a client does not attend their appointment or cancels late, the full treatment cost will be deducted from the voucher balance.
• If the voucher balance does not cover the full cost, the remaining amount will be payable by the client.
6.4. E-gift Vouchers
• E-gift vouchers are delivered instantly to the email address provided at checkout.
• They can be used towards any treatment at Mowhay.
• If the full value is not redeemed in one visit, the remaining balance will remain available until the expiry date.
• Remaining balances cannot be transferred once the voucher has expired.
• Mowhay cannot accept responsibility for delays or failed delivery caused by incorrect email details.
6.5. Printed Gift Cards
• Printed gift cards can be posted via Royal Mail or collected from Mowhay by pre-arrangement.
• Delivery times are estimated and cannot be guaranteed (3 – 5 working days) excluding Bank Holidays, Easter and Christmas.
• If collecting in person, please contact giftvouchers@mowhaytreatments.com to arrange a suitable time.
• If you choose to have the card posted to you to give in person, please note an additional presentation envelope is not included.
6.6. Refunds
• Gift vouchers are non-refundable once purchased.
• Vouchers cannot be exchanged for cash, either in full or in part.
6.7. Non-transferable
• Vouchers may be used by the intended recipient only and cannot be resold or used for commercial purposes.
6.8. Promotions & Discounts
• Gift vouchers cannot be purchased using promotional codes or applied against promotional offers unless explicitly stated.
6.9. Mowhay Rights
• Mowhay reserves the right to amend these terms at any time.
• In cases of suspected fraud, misuse, or tampering, Mowhay may refuse acceptance of a voucher.

7. Client Responsibilities & Health Declarations
1. You must complete a consultation form before your first treatment, disclosing all relevant medical conditions, allergies, medications, and health concerns.
2. You must inform us immediately of any changes to your health status, including new medications, medical conditions, or allergies.
3. It is your responsibility to inform your therapist of any discomfort, pain, or adverse reactions during treatment.
4. If you have any concerns about whether a treatment is suitable for you, please consult your GP before booking.
5. You must not attend your appointment if you have any infectious or contagious conditions, including colds, flu, skin infections, or other communicable diseases.
6. We reserve the right to refuse or discontinue treatment if we believe it may be unsafe or unsuitable for you.
7. You must not be under the influence of alcohol or recreational drugs when attending appointments.
8. You are responsible for following any aftercare advice provided by your therapist.
8. Age Restrictions & Parental Consent
1. Clients must be over 16 years of age to receive treatments independently.
2. Clients under 16 years of age must be accompanied by a parent or legal guardian and have written parental consent.
3. Only certain treatments are available to clients under 16. Please contact us to discuss suitable options.
9. Client Conduct
1. We expect all clients to treat our therapists and staff with courtesy and respect.
2. Aggressive, abusive, threatening, or inappropriate behaviour towards staff will not be tolerated and may result in immediate termination of your appointment without refund and a permanent ban from our premises.
3. Please ensure mobile phones are switched to silent mode during treatments to maintain a peaceful environment for all clients.
4. We ask that you respect the tranquil environment and speak quietly in treatment areas and waiting spaces.
5. Clients are responsible for their personal belongings. We cannot accept liability for lost, stolen, or damaged items.
6. Our premises are a no-smoking environment. Smoking is not permitted anywhere on the property.
10. Treatment Provision & Professional Standards
1. All treatments are provided by qualified and insured therapists in accordance with industry standards and best practices.
2. We use high-quality, professional-grade products. If you have any concerns about products or ingredients, please inform your therapist before treatment.
3. Treatment results may vary between individuals. We do not guarantee specific outcomes or results.
4. Our treatments are for cosmetic and relaxation purposes and are not substitutes for medical treatment. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
5. We reserve the right to modify treatments or substitute products where necessary, and will inform you of any significant changes.
6. Some treatments may have temporary side effects such as redness, tenderness, or minor bruising. Your therapist will discuss these with you before treatment.
7. Certain treatments have specific contraindications. We reserve the right to refuse treatment if we believe it would be unsafe.
11. Liability & Disclaimers
1. Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under UK law.
2. Subject to the above, we shall not be liable for any loss or damage arising from your failure to disclose relevant medical information or follow aftercare instructions.
3. We maintain comprehensive professional indemnity and public liability insurance.
4. We are not liable for allergic reactions where you have failed to disclose known allergies or where a patch test has been refused.
5. You acknowledge that you are voluntarily participating in treatments and assume any inherent risks.
6. We are not liable for any personal belongings that are lost, stolen, or damaged on our premises.
7. If you experience any adverse reactions following treatment, you must notify us immediately and seek medical attention if necessary.
12. Complaints Procedure
1. We are committed to providing excellent service. If you are dissatisfied with any aspect of your experience, please let us know.
2. Complaints should be made in writing to info@mowhaytreatments.com or by post to Manor Farm, Church Street, Chilcompton, Somerset BA3 4HP.
3. We will acknowledge receipt of your complaint within 3 working days and aim to provide a full response within 14 working days.
4. If your complaint relates to a specific treatment, please raise it within 7 days of your appointment to allow us to address the matter promptly.
5. We will investigate all complaints thoroughly and work with you to find a satisfactory resolution.
13. Intellectual Property
1. All content on our website, social media, and marketing materials, including text, images, logos, and treatment protocols, is owned by Mowhay or licensed to us and is protected by UK and international copyright laws.
2. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.
3. The Mowhay name and logo are trademarks and may not be used without our express written consent.
4. We may take photographs or videos on our premises for marketing purposes. If you do not wish to be photographed, please inform staff upon arrival.
5. By providing testimonials or reviews, you grant us permission to use your feedback in our marketing materials.
14. Data Protection & Privacy
1. We are committed to protecting your personal data in accordance with UK GDPR and the Data Protection Act 2018.
2. For full details of how we collect, use, and protect your personal information, please refer to our separate Privacy Policy available on our website or upon request.
3. Your personal data will be used solely for the purposes of providing treatments, managing appointments, and communicating with you about our services.
4. You have the right to access, correct, or request deletion of your personal data at any time by contacting us.
15. Changes to Terms & Conditions
1. We reserve the right to update these Terms and Conditions at any time.
2. The most current version will always be available on our website and will be date-stamped.
3. Continued use of our services following any changes constitutes acceptance of the revised Terms and Conditions.
4. Significant changes will be communicated to existing clients via email where possible.
5. Terms agreed at the time of booking will apply to that specific appointment.
16. Governing Law & Jurisdiction
1. These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
2. Any disputes arising from these Terms and Conditions or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
3. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
